The lawsuit against Germany-based EngineOwning, spotted by GamesIndustry.biz, was filed this week and alleges that the company is “engaged in the development, sale, distribution, marketing, and exploitation of a portfolio of malicious cheats and hacks for popular online multiplayer games, most prominently the [Call of Duty] games”.
According to the document almost all modern Call Of Duty games are affected, and Blizzard’s (Activision’s affiliate) Overwatch is also suffering from cheating software developed by EngineOwning.
The defendants allegedly develop and distribute (via the website at EngineOwning.to) a portfolio of cheats and hacks for popular online games, including those in the Call of Duty series. According to Activision, the defendants are also preparing new cheating software for Overwatch, which is published by its affiliate Blizzard Entertainment.
EngineOwning’s cheats, according to its website, include auto-aiming, auto-firing, and showing the location of other players, for a price ranging from €4.49 (three-day access) to €139.99 (90 days).
The cheats do things like allow players to see opponents through walls, automatically aim with aimbots, and generally give them typically unseen information. These malicious software products are being brought up in the lawsuit as Activision claims have “caused Activision to suffer massive and irreparable damage to its goodwill and reputation and to lose substantial revenue.”
Activision says that the defendants’ conduct has unjustly enriched them and caused damage to its business. As a result, it is seeking the maximum statutory damages of $2,500 for each violation of the DMCA or, in the alternative, defendants’ profits attributable to their violations. It’s alleged that the defendants made “hundreds of thousands of dollars, or more,” from their distribution and sale of the software.
The publisher rolled out Warzone’s anti-cheat kernel-level driver globally last month.
